In the event that your pool does not meet the safety requirements during our initial inspection, there’s no need to panic. At Precise Pool Inspections, we’re committed to working with you to ensure your pool becomes compliant.

We’ll issue a Form 26 – Nonconformity Notice, detailing the areas where your pool does not meet the QLD government’s safety standards. You’ll then have 90 days to rectify the listed issues.

What is the difference between a shared pool and a single residential pool inspection

When it comes to pool safety inspections, it’s important to distinguish between single residential pools and shared pools, as they each have specific considerations and requirements.

A single residential pool is typically found in private homes and is exclusively used by the homeowners and/or tenants and their guests. In this case, the responsibility for pool safety and compliance with Queensland’s pool safety laws falls squarely on the homeowner. The inspections focus on factors like pool barriers, gates & latches, CPR signage, surrounding areas, and overall compliance with the QLD government’s safety requirements.

On the other hand, a shared pool is one that’s associated with multi-unit complexes like strata titled apartments, townhouses, villas, duplexes, or hotels & resorts and is available for use by multiple tenants or guests. Responsibility for these pools usually lies with the property management, body corporate, or business owner. Inspections for shared pools include the same safety factors as single residential pools, but they also consider additional factors like signage, rescue equipment, and wider accessibility routes.

The safety requirements for both types of pools are enforced by the Queensland government and aim to prevent drowning and serious immersion injuries, particularly in young children.

Queensland Legislation Requirements for Pool Owners

Swimming Pool Barrier Inspection

According to Queensland law, pool owners must fulfill specific obligations. They are mandated to register their pools online and perform a self-assessment, accompanied by a formal statement affirming that, to the best of their knowledge, their pool barriers adhere to the relevant safety standards. These requirements encompass both indoor and outdoor swimming pools, as well as spas located on premises where a moveable dwelling or residential building is present.

Pool Barrier Compliance Requirements

The pool owner in Queensland holds the responsibility of ensuring that their pool meets the required safety standard. Even if neighboring properties do not comply with the pool safety standard, the law still mandates the pool owner to take necessary steps to ensure that their pool barrier meets the standard. Here are some key areas of compliance that pool owners should carefully consider.

Queensland Pool Owners Fencing, Gates and Latches Regulations

In accordance with the law, the prescribed minimum height for a pool fence is 120cm, measured from ground level upwards. Moreover, the vertical members, such as rods, wire, or palings, must not be spaced more than 10cm apart. As a Queensland pool owner, it is essential to ensure that your gates do not open towards the swimming pool area. Furthermore, as per the pool safety standard, the gate latch releases must be positioned at least 150cm above the ground or adequately shielded. Additionally, it is crucial to keep your pool gates and doors closed at all times when not in use.

The Non-Climbable Zone

To prevent children from accessing the pool by climbing over the barrier, it is necessary to establish a non-climbable zone around the swimming pool. The safety standard mandates a 90cm non-climbable zone along the entire length of the pool barrier. In cases where the pool fence also serves as a dividing fence and is less than 180cm in height, the non-climbable zone should be positioned on the outer side. The provision of the non-climbable zone also takes into account various elements such as outdoor furniture, climbable trees, projections, retaining walls, indentations, and other objects that may offer a horizontal surface that children could use to gain a foothold or handhold while attempting to climb the barrier.

Child Resistant Doors

If you own a pool in Queensland, it is important to note that the pool safety standard prohibits the use of self-latching and self-closing child-resistant doors as the sole barrier for direct access into the pool area. As of November 2015, any exemptions previously granted by local government authorities regarding this matter have officially expired. The Queensland Injury Surveillance Unit has identified child-resistant doors as a significant safety risk. To comply with the regulations, it is necessary to install a separate fence between the pool and the building, ensuring that the doors are upgraded accordingly. The only situation where compliance may be deemed impractical is if erecting a barrier would require demolishing a section of the building. However, such exemptions can only be granted after verification by the relevant local government department responsible for assessing the feasibility of the request.

Cardiopulmonary Resuscitation (CPR) Signs

In accordance with the pool safety standard, it is mandatory for every pool owner to prominently display a CPR sign near the pool area where it can be easily seen. The sign must adhere to the Australian Resuscitation Council guidelines, which stipulate a minimum size of 30cm by 30cm and it should be constructed from a durable and weatherproof material. The sign should provide clear instructions and illustrations, guiding the public or pool users on what to do in case of an emergency. Failure to comply with this regulation may result in fines imposed by the local government.
